Garnishment in enforcement proceedings
Information on account and income attachment, third-party duties and statutory enforcement limits.
What is garnishment?
Garnishment may target attachable sums owed to the debtor or held on their behalf by a third party. It may involve bank accounts, wages, pensions or other claims, subject to law.
The third party receives procedural documents and has duties under the Romanian Code of Civil Procedure. The debtor is notified of the measure under applicable rules.
Income protection
Wages, pensions and other periodic income are subject to statutory attachment limits. The debt's nature, multiple enforcements and income level affect the amount withheld. Certain income enjoys special protection.
Calculation depends on individual circumstances. Funds entering an account do not all share the same legal treatment; their source may require supporting evidence.
