Notification and service of documents

Notification of judicial and extrajudicial documents aims to officially inform the recipient of a document, a factual or legal situation or a request to act or refrain from certain conduct.

Judicial and extrajudicial documents

• Judicial documents are issued or used in proceedings: summonses, claims, judgments, appeals and other procedural documents.
• Extrajudicial documents do not originate from a court and may concern payment demands, formal notices of default or contractual communications.

Service by an officer — Art. 154(5), Romanian Code of Civil Procedure

At the interested party's request and expense, procedural documents may be served directly by an enforcement officer, observing statutory formalities.

Transmission and proof of service

Depending on the document and procedure, transmission may be through a process-serving agent or postal services, with appropriate proof. Service records show the result and are made available to the applicant.

The specific timescale and method depend on the recipient's address, submitted documents and procedural requirements.

The officer notifies judicial and extrajudicial documents and serves procedural documents, subject to law.
